Terms and Conditions

1. General Terms

These Terms and Conditions apply to all services provided by The Viking Webdesign, a sole proprietorship registered in the Netherlands. All agreements are governed exclusively by Dutch law. These terms are written in English for accessibility; however, Dutch law prevails at all times.

Definitions:
Client: Any individual or entity engaging Viking services.
Services: All web, plugin, hosting, and development services offered.
Agreement: Any accepted quotation or signed contract.
Deliverables: All files, code, and materials produced.

2. Services Offered

• Website development
• Plugin development
• Hosting & maintenance
• Custom WordPress solutions

3. Quotations & Acceptance

All quotations are valid for 30 days. Acceptance must be confirmed in writing. Projects commence only after receipt of the agreed deposit. Any changes to scope require written approval and may result in additional fees.

4. Pricing & Payment

All prices exclude 21% VAT. Standard payment terms are 50% upfront and 50% upon delivery. A payment plan of 12 months at €235/month may be agreed in writing. Payment term is 7 days net. Late payments incur 1.5% monthly interest. Accepted methods: Bank transfer and PayPal (+3% fee).

5. Project Timeline

Standard delivery is 3–4 weeks from deposit. Timelines pause if content is not supplied within 7 days. Client feedback is required within 5 business days. Delays exceeding 14 days due to client inaction incur a €195 restart fee.

6. Revision Policy

Three revision rounds are included. Additional revisions are billed at €125/hour (minimum 1 hour).

7. Client Responsibilities

Clients must provide content within 7 days, respond within 5 business days, submit feedback in writing, consolidate feedback per revision round, and clearly specify change locations.

8. Deliverables & Code Ownership

Full source code ownership transfers upon final payment. No vendor lock-in applies. All files and documentation are provided.

9. Hosting Services

Hosting & maintenance are €85/month and include backups, security monitoring, updates, and 1 hour support. Cancellation requires 30 days notice.

10. Warranty & Bug Fixes

A 14-day bug warranty applies. Bugs are functional issues present at launch. Additional fixes are billed at €125/hour.

11. Cancellation Policy

Before work: full refund minus €195 admin fee. After start: 50% non-refundable. No refunds after revision round two.

12. Intellectual Property

Custom code transfers to client upon payment. Third-party licenses remain subject to original terms. Viking branding remains Viking property.

13. Confidentiality

Both parties must protect confidential information. Viking may showcase completed work unless an NDA applies.

14. Liability Limitation

Liability is limited to the total amount paid. Viking is not liable for indirect damages or ranking guarantees.

16. Force Majeure

Neither party is liable for events beyond reasonable control.

17. Governing Law & Disputes

Dutch law applies. Disputes are resolved via mediation, then courts of Hoorn.

18. Changes to Terms

Terms may change with 30 days notice. Continued use constitutes acceptance.
